Your Inheritance and the TDT

We understand that you have recently experienced the loss of a loved one – please accept our condolences.

Your loved one entrusted us with their estate planning, to ensure that their inheritance wishes were carried out. As part of this process, they wanted to provide you with the best opportunities in relation to your inheritance, so they took the time, and went to the expense, of providing a testamentary discretionary trust (TDT) in their Will so that you could place some or all of your inheritance into it. The TDT offers you, as a beneficiary, additional benefits which this page, and our video below, will explain in further detail.

Please note that this page is dedicated to beneficiaries who have been given a choice in a Will drafted by Estate First Lawyers, as to whether to take their inheritance in a TDT or in their personal name. If you are unsure if you have this choice, please check with us or your own legal advisor.

The ’one-off’ opportunity of the TDT

Please consider your decision carefully, as the TDT is a ‘one off’ opportunity and if you decide not to take it, you cannot later change your mind. TDTs are only available to those who inherit one under a Will.

A TDT has the following advantages:

  • Tax advantages icon

    Tax advantages – a TDT provides beneficiaries of the TDT with tax opportunities on income earned from an inheritance after it has been received into the TDT. The advantages are that the TDT can share income to get the benefit of individual tax thresholds and the significant tax free threshold applicable for minors in the TDT (such as your children or grandchildren) and

  • Asset protection icon

    Asset protection – the TDT also provides greater asset protection for your inheritance than if you hold your inheritance in your own name. Your assets held in the TDT are generally safe from your bankruptcy and it is better to have assets in the TDT if you are at risk of a relationship breakdown.
